Social Health Authority (SHA) Employer Portal Terms and Conditions

Welcome to the Social Health Authority (SHA) Employer Portal. These Terms and Conditions govern the use of the Employer Portal for registration and making contributions to the Social Health Insurance Fund (SHIF). By accessing and using the Employer Portal, you agree to comply with these Terms and Conditions.

1. Definitions
  • Employer: Any entity registered under Kenyan law and authorized to operate within Kenya.
  • Employee: An individual employed by the Employer and eligible for registration and contribution to the SHIF.
  • Portal: The online platform provided by SHA for Employers to register and make contributions.
  • Data: Any information related to Employers and Employees collected, stored, or processed through the Portal.
2. Eligibility
  • Employers must be legally registered and compliant with Kenyan laws to use the Portal.
  • The Employer must have valid credentials provided by SHA to access the Portal.
3. Registration
  • Employers must provide accurate and complete information during registration.
  • Employers are responsible for maintaining the confidentiality of their login credentials.
  • SHA reserves the right to verify the information provided and to approve or reject the registration based on compliance with legal requirements.
4. Contributions
  • Employers are responsible for timely and accurate contributions to the SHIF on behalf of their Employees.
  • Contributions must be made in accordance with the rates and deadlines specified by SHA.
  • Failure to make timely contributions may result in penalties as stipulated by Kenyan law.
5. Data Handling and Protection
  • SHA will handle all data in compliance with the Kenya Data Protection Act, 2019.
  • Employers must ensure that all data provided is accurate, up-to-date, and relevant for the purposes of registration and contributions.
  • SHA will take appropriate measures to protect the confidentiality, integrity, and availability of the data.
  • Data will only be used for purposes related to the administration of the SHIF and as permitted by law.
  • Employers must obtain consent from Employees before submitting their personal data through the Portal.
  • Any data breaches must be reported immediately to SHA in accordance with the Data Protection Act.
6. User Responsibilities
  • Employers must use the Portal in compliance with all applicable laws and regulations.
  • Employers must not misuse the Portal or engage in any activities that may harm the Portal's functionality or SHA's operations.
  • Employers must ensure the security of their login credentials and immediately report any unauthorized access or suspected breaches to SHA.
7. Termination
  • SHA reserves the right to terminate or suspend access to the Portal for any Employer that violates these Terms and Conditions or any applicable laws.
  • Employers may terminate their use of the Portal by providing written notice to SHA.
8. Limitation of Liability
  • SHA will not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Portal.
  • SHA does not guarantee the continuous, uninterrupted, or error-free operation of the Portal.
9. Amendments
  • SHA reserves the right to amend these Terms and Conditions at any time. Employers will be notified of any changes, and continued use of the Portal constitutes acceptance of the amended terms.
10. Governing Law
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya.
  • Any disputes arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Kenyan courts.
